CNS affiliation after a vacation job

Students who are still living with their parents have to re-affiliate with a parent at the CNS after a vacation job. Deputy Gilles Baum has heard that many people are not aware of this. In order to avoid nasty surprises in the event of illness, the leader of the DP group asks if, in the context of co-insurance, an automation could not be introduced to reassure children about their parents without further steps.

« Selon l’article 7 du Code de la sĂ©curitĂ© sociale, une coassurance d’un enfant sous l’affiliation d’un parent est possible jusqu’à l’âge de 29 ans inclus, Ă  condition que, d’une part, l’enfant Ă  coassurer dispose de ressources infĂ©rieures au revenu minimum garanti pour une seule personne, et que, d’autre part, l’intĂ©ressĂ© ne soit pas affiliĂ© personnellement auprès du Centre commun de la sĂ©curitĂ© sociale (CCSS).

Notant que la coassurance d’un enfant nĂ© au Grand-DuchĂ© s’opère de manière automatique, sans qu’aucune dĂ©marche de la part du parent ne soit requise.

Or, il me revient que les Ă©tudiants, qui ont Ă©tĂ© affiliĂ©s auprès de la CCSS en raison d’un contrat d’Ă©tudiant pendant les vacances scolaires, ne sont plus assurĂ©s dans le chef de leur parent après la cessation du contrat, sauf s’ils prennent l’initiative de rĂ©gulariser la situation. La rĂ©affiliation ne se fait donc plus de manière automatique, mais requiert une dĂ©marche de leur part.

Dans ce contexte j’aimerais poser les questions suivantes à Monsieur le Ministre de la Sécurité sociale:

  • Monsieur le Ministre peut-il confirmer les affirmations relatĂ©es ci-dessus?
  • Dans l’affirmative, Monsieur le Ministre dispose-t-il des donnĂ©es combien de personnes ont omis de rĂ©gulariser leur situation ? Quelles en sont les consĂ©quences?
  • Toujours dans l’affirmative, Monsieur le Ministre entend-il prendre des mesures afin de remĂ©dier Ă  cette situation? Est-ce qu’une rĂ©affiliation automatique des Ă©tudiants, dont le contrat d’Ă©tudiant est venu Ă  terme, est envisageable? »
