Use of government logo for own purposes legal?

Recently, three associations ran an ad where they used the logo of the Ministry of Agriculture for their purposes, so that the reader could think it was an official announcement from the government. The DP MP Gusty Graas asked the Minister of Agriculture if this is legal and what he intends to do about it.

« Les trois associations « Greenpeace Luxembourg », « Mouvement écologique » et « natur&ëmwelt asbl » ont publié une annonce le 1er décembre dans la presse nationale qui semble vouloir induire le lecteur en erreur. En effet, l’entête de l’annonce reproduit le logo officiel des ministères luxembourgeois en changeant l’intitulé du ministère de l’Agriculture, de la Viticulture et du Développement rural en « Ministère de l’Agriculture durable ». Le ministère concerné a déjà réagi par communiqué de presse pour se distancier de l’annonce et pour dénoncer la manière de communiquer desdites associations.

Dans ce contexte, j’aimerais poser les questions suivantes à Monsieur le Ministre de l’Agriculture, de la Viticulture et du Développement rural :

  • Est-ce légal de reproduire le logo officiel du Gouvernement pour induire le lecteur en erreur ?
  • Dans la négative, est-ce que Monsieur le Ministre compte entreprendre des démarches supplémentaires contre ces trois associations ?
  • Quelle est l’attitude de Monsieur le Ministre face à cette manière de communiquer ?»
